Ellen Greenberg: Philadelphia: Bulletin: Major (Unwelcome) Development: Outside prosecutors say they cannot prove beyond a reasonable doubt that a crime was committed in the case of Ellen Greenberg, the Philadelphia educator who died in 2011 - a case her parents have long fought to be called a homicide but was instead ruled as a suicide…"In a news release, the Chester County District Attorney's Office said the case was being placed into an inactive status. The agency has been handling the case due to conflicts within Philadelphia and the Pennsylvania AG's office. Chester County detectives reviewed prior investigations by the Philadelphia Police Department and the AG's office, conducted new interviews and consulted with an independent forensic expert, among other investigative steps."
Canadian Pathologists (And Other Experts) Under Fire: Former Dr. Charles Smith; Dr. John Penistan: (The Guy Paul Morin Case): I dig into my archives to revisit the role played by Dr. Penistan in the Ontario Guy Paul Morin case and explore possible comparisons with the discredited former doctor Charles Smith………..Passage from Prof. James C. Morton. Ottawa Citizen…."Last week we were reminded daily of the miscarriages of justice caused by forensic pathologist Charles Smith -- the many parents and caregivers charged and some found guilty of murdering children, the scores of lives ruined, and families destroyed," it continues. "And in August, the Ontario Court of Appeal said that one of its main reasons for acquitting Steven Truscott had to do with the testimony of John Penistan, the pathologist in that long-ago case of rape and murder. Dr. Penistan's official autopsy report stated that 12-year-old Lynne Harper had died soon after Steven Truscott had been seen giving her a ride on his bike, at a time when he would have been by far the most likely killer. But in recent years researchers have found two earlier copies of the same report form, one of them filled out during the autopsy, both placing the girl's time of death much later, when Mr. Truscott absolutely could not have been the killer. Said the Court: "(The) nature of the changes in his opinion leaves Dr. Penistan's evidence reasonably open to the allegation that his opinion shifted to coincide with the Crown's case against the appellant."
Silvon Simmons: Rochester: ShotSpotter evidence: Question of the day: How wrongful convictions reveal the dangers of unvalidated science — and are we about to repeat the same mistakes with AI?, published by The Innocence Project on October 3, 2024…"While Mr. Simmons narrowly escaped a wrongful conviction, the very introduction of ShotSpotter evidence in his case reflects a disturbing readiness among some system actors, especially prosecutors, to accept AI-based evidence at face value. This eager acceptance mirrors the same flawed embrace of misapplied forensic science, which has contributed to numerous wrongful convictions. “Half of the Innocence Project’s victories to date involved wrongful convictions based on flawed forensic science,” Vanessa Meterko, Innocence Project’s research manager, said. “We don’t want to see this same pattern with untested or biased AI in the years to come.”
Drug 'experts' versus 'junk science': 'Junk science' wins, according to MLive Investigative Reporter Gus Burns, in a story headed: "It's junk science: Michigan sets precedent for so-called drug 'experts.'…"She was pulled over on December 2020 on her way to the gas station by an Ottawa County Sheriff’s deputy for a burnt out headlight. That led to her arrest for driving under the influence and her court case raised questions about the validity of Drug Recognition Experts (DRE), a decades-old, national program that has trained officers to become “experts” at detecting impairment from drug use."
'Sing Sing' Actor JJ Velazquez: Exonerated at long last (through DNA testing unavailable at the time of his trial) after almost 24 years in prison, having been sentenced to life imprisonment for the 1998 murder of a retired policeman during an armed robbery at an illegal gambling den in Harlem…."The campaign to free Velazquez gathered pace in 2002 when a Dateline NBC investigation led by producer Dan Slepian focused on evidence that the then 22-year-old was wrongly identified as one of two perpetrators of the deadly robbery at the center of the case. The Manhattan district attorney’s office opposed two motions by Velazquez to vacate the conviction – in 2014 and 2018 – but reopened its investigation in 2022 through its newly formed post-conviction investigative unit. It found that DNA found on a betting slip handled by the person who shot and killed the retired police detective, Albert Ward, during a struggle was not a match to Velazquez. The testing was not available at the time of his trial."
